If you receive Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI), federal rules dictate that you can\u2019t have resources (including savings accounts) that are worth more than $2,000 for a person or $3,000 for a married couple living together. So the answer to the savings question would seem to be \u201cno,\u201d and it was\u2014until December 2014 and the passage of the \u201cAchieving a Better Life Experience Act,\u201d which allows eligible Americans with disabilities the opportunity to save as much as $17,000 a year (and in some cases, more).<\/p>\n<p>Many people with disabilities receive some sort of state or federal benefits, like Social Security, Medicaid, or food or housing assistance. Unfortunately, these benefits come with income and asset caps. In other words, people have to choose between saving (or making) money or keeping necessary benefits. The Achieving a Better Life Experience (ABLE) act resolves this issue: Eligible people with disabilities now have the option to save or invest money in a tax-free account without fearing the loss of benefits. They can save up to <a href=\"https:\/\/www.oregonablesavings.com\/testimonials-1\/#erin\" target=\"_blank\" rel=\"noopener\">purchase a service dog,<\/a> <a href=\"https:\/\/www.oregonablesavings.com\/testimonials-1\/#corinne\" target=\"_blank\" rel=\"noopener\">apply for a well-paying job without worrying about losing benefits<\/a>, or even buy a new house.<\/p>\n<h2><strong>What Are the Benefits of an ABLE Account?<\/strong><\/h2>\n<p>\u201cHaving a disability is expensive,\u201d says Kaellen Hessel-Owens, the Oregon State Treasury\u2019s Oregon ABLE Outreach Manager. \u201cResearch from the National Disability Institute shows that households with one adult who has a disability need 28% more income on average to obtain the same standard of living as a similar household without a member who has a disability. Oregon ABLE can help make up for some of that gap.\u201d<\/p>\n<p>Besides being tax-free, Oregon ABLE\u2019s Cash Option\u2019s current interest rate is higher than most other rates available, and Oregon ABLE account holders qualify for a <a href=\"https:\/\/www.oregonablesavings.com\/faqs\/2020\/1\/23\/what-is-the-oregon-income-tax-credit\" target=\"_blank\" rel=\"noopener\">refundable income tax credit.<\/a><\/p>\n<p>\u201cABLE accounts seem to be the only way to combat the encouraged impoverishment that is set by asset limits,\u201d says Annie Steiner, Financial Advocacy Specialist at ALSO. \u201cABLE accounts are the Noah&#8217;s ark of savings for people with disabilities.\u201d<\/p>\n<h2><strong>Understanding ABLE Account Eligibility<\/strong><\/h2>\n<p>If you have a significant disability with an onset before age 26 and are already receiving SSI and\/or SSDI benefits, you\u2019re automatically eligible to open an ABLE account.<\/p>\n<p>But it&#8217;s not just people receiving Social Security who can benefit from ABLE accounts. If you acquired a disability before age 26 and meet Social Security\u2019s definition and criteria regarding significant functional limitations, you can file a disability certification. This certification, which includes information about your disability and must be signed by a physician, certifies that you:<\/p>\n<ul>\n<li>Have a medically determinable physical or mental impairment that is permanent (lasting for a continuous period of not less than 12 months) and\/or terminal.<\/li>\n<li>Are blind (as defined in <a href=\"https:\/\/secure.ssa.gov\/poms.nsf\/lnx\/0426001001#:~:text=Sections%20216%20%28i%29%20%281%29%20and%201614%20%28a%29%20%282%29,to%20determine%20if%20the%20claimant%20meets%20this%20definition.\" target=\"_blank\" rel=\"noopener\">section 1614(a) (2) of the Social Security Act<\/a>).<\/li>\n<\/ul>\n<p>Note that you can be over 26 years old when you open an ABLE account, you just need to have acquired your disability before that age.<\/p>\n<p>That age limit is increasing soon. <a href=\"https:\/\/patf.us\/president-biden-signs-able-age-adjustment-act-into-law\/\" target=\"_blank\" rel=\"noopener\">The ABLE Adjustment Act<\/a> was signed into law on December 24, 2022, and <strong style=\"font-size: 20px;\">will increase the age of ABLE eligibility from \u201cbefore age 26\u201d to \u201cbefore age 46\u201d <\/strong>effective\u00a0<strong style=\"font-size: 20px;\">January 1, 2026. You\u2019ll provide limited information about you or your beneficiary (to determine ABLE eligibility), decide how you\u2019ll fund your account, and <a href=\"https:\/\/www.oregonablesavings.com\/how-it-works\" target=\"_blank\" rel=\"noopener\">choose either a cash or investment option<\/a>.\u00a0 ABLE accounts in Oregon allow you to save your money in an FDIC-insured savings account or invest it in one of three types of financial portfolios: ABLE Conservative, ABLE Moderate, or ABLE Aggressive. Each investment option contains a different ratio of stocks and bonds within a portfolio of mutual funds. There\u2019s a $25 minimum deposit to open your Oregon ABLE account.<\/p>\n<p>\u201cThe account can be managed online,\u201d says Mrs. Hessel-Owens, \u201cso it\u2019s easy to access, contribute, withdraw, or load money to a prepaid card. The Oregon ABLE Savings Plan also offers <a href=\"https:\/\/www.oregonablesavings.com\/events\" target=\"_blank\" rel=\"noopener\">free monthly webinars<\/a> that explain Oregon ABLE account plans in detail.\u201d<\/p>\n<p>If you don\u2019t live in Oregon, you can access a similar plan, ABLE for All (powered by the state of Oregon) or check out other options and compare plans at <a href=\"https:\/\/www.ablenrc.org\/get-started\/what-can-funds-be-used-for\/\" target=\"_blank\" rel=\"noopener\">The ABLE National Resource Center<\/a> (managed by the\u00a0<a href=\"https:\/\/www.nationaldisabilityinstitute.org\/\">National Disability Institute<\/a>). A tip from Mrs. Hessel-Owens: \u201cIf someone searches for ABLE accounts online, the top result is usually an ad, and it will not necessarily be for their own state\u2019s program\u201d (which could be important for state tax credit eligibility).<\/p>\n<h2><strong>FAQs About ABLE Accounts<\/strong><\/h2>\n<ul>\n<li><strong>How much are ABLE account fees?<\/strong> The fees for ABLE accounts vary depending on the state and the specific ABLE program. Oregon ABLE accounts carry an annual fee of $35, as well as annual administrative and investment fees that add up to between 0.30% and 0.34% of the account\u2019s balance per year. <a href=\"https:\/\/www.oregonablesavings.com\/faqs\/fees\" target=\"_blank\" rel=\"noopener\">Other fees may apply.<\/a><\/li>\n<li><strong>What is the ABLE account maximum contribution? <\/strong><a href=\"https:\/\/www.irs.gov\/pub\/irs-pdf\/p907.pdf\" target=\"_blank\" rel=\"noopener\">According to the IRS<\/a>, ABLE accounts are limited to the annual gift tax exclusion amount <a href=\"https:\/\/www.kiplinger.com\/taxes\/gift-tax-exclusion\" target=\"_blank\" rel=\"noopener\">($17,000 for 2023) <\/a>ABLE account owners who are employed and do not participate in an employer sponsored retirement plan (within that calendar year)\u00a0<a href=\"https:\/\/www.ablenrc.org\/able-account-contribution-limits-2023\/\" target=\"_blank\" rel=\"noopener\">may make additional contributions, up to $13,590 in 2023 for those who reside in the continental U.S.<\/a> This limit may be subject to change, so it&#8217;s important to consult your specific ABLE program or state for the most up-to-date information.<\/li>\n<li><strong>Are ABLE accounts tax deductible<\/strong>? Contributions made to ABLE accounts are not tax-deductible at the federal level, although some states may allow deductions. Oregon does not offer a tax deduction, but a contribution to an Oregon ABLE account makes one eligible for a refundable <a href=\"https:\/\/www.oregonablesavings.com\/faqs\/2020\/1\/23\/what-is-the-oregon-income-tax-credit\" target=\"_blank\" rel=\"noopener\">state income tax credit<\/a> of up to $340.<\/li>\n<li><strong>Are ABLE accounts taxable?<\/strong> ABLE account earnings are not subject to federal income tax as long as the funds are used for qualified disability expenses. However, if ABLE account funds are used for non-qualified expenses, they may be subject to taxes and penalties.<\/li>\n<li><strong>What can ABLE account funds be used for? <\/strong>ABLE account funds can be used for <a href=\"https:\/\/www.ablenrc.org\/get-started\/what-can-funds-be-used-for\/\" target=\"_blank\" rel=\"noopener\">a wide range of qualified disability expenses (QDEs)<\/a>, including education, food, housing, transportation, assistive technology, employment training and support, personal support services, health care expenses, financial management, and more.<\/li>\n<li><strong>Who can open an ABLE account? <\/strong>If an eligible person with a disability (see \u201cABLE Account Eligibility\u201d above) can\u2019t open or manage an ABLE account by themselves, an Authorized Legal Representative (ALR) may do so for them. An ALR can be a person with legal capacity who is selected by the eligible beneficiary, anyone who has Power of Attorney, a conservator or legal guardian, a spouse, parent, sibling, or grandparent, or a representative payee (individual or organization). ALSO is certified as an ALR and may open ABLE accounts for eligible people in their care who wish to have accounts.<\/li>\n<li><strong>Who can contribute to an ABLE account?<\/strong> Anyone can contribute to an ABLE account on behalf of an eligible individual with a disability, including friends and family members. Contributions can also be made from Special Needs \/ Pooled Trusts and 529 College Savings Account rollovers.<\/li>\n<\/ul>\n<h2><strong>Are ABLE Accounts Worth It?<\/strong><\/h2>\n<p>\u201cAbsolutely\u201d, says Ms. Steiner, who was so impressed with the benefits of ABLE accounts that she opened over twenty ABLE accounts for people supported by ALSO within her first month and a half.<\/p>\n<p>It\u2019s also important for families of children with disabilities to recognize the advantages of opening an ABLE account. \u201cOften, families don\u2019t realize that when their child turns 18, they may begin qualifying for benefits that they weren\u2019t eligible for previously, \u201c says Mrs. Hessel-Owens. \u201cSaving in an Oregon ABLE account while the child is young allows them to be better prepared for that transition to adulthood.\u201d<\/p>\n<p>\u201cIt\u2019s a way to build a future\u201d agree Ms. Steiner. \u201cTo be able to participate in your life and the kind of life that you desire while still receiving instrumental government benefits.
